1. Acceptance of Terms

By accessing and using Wispers ("Service", "Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Wispers provides a platform for conversations with AI personas. The Service allows users to engage in text-based conversations with various AI-generated personalities for entertainment, companionship, and dialogue purposes.

3. User Rules and Obligations

By registering and using the Service, you declare and agree that:

  1. You have read, understood, and fully accepted all provisions of these Terms of Service and the Privacy Policy.
  2. You consent to the processing of your personal data by the Administrator, including publicly displaying profile photos and information you choose to share.
  3. You consent to receiving technical or informational communications from the Administrator via email, as well as messages from other users of the Service.
  4. You possess all required rights, including copyright and intellectual property rights, to content you publish on the Service, including any images of yourself or third parties.
  5. All data and information you share complies with applicable laws and does not violate the rights of other users or third parties, particularly under criminal law, civil law, social norms, and good customs.
  6. You will respect the absolute prohibition on posting any data, content, or materials concerning minors in the Service.
  7. You will refrain from copying Service information and materials for further distribution.
  8. You will not post mentions or advertisements of other services and applications, particularly other chat platforms, social media, or messengers.
  9. You will not share personal information about other users without their explicit consent.
  10. You are solely and fully responsible for the data and materials you post, and bear complete liability for violations of law or rights of other users or third parties.
  11. You acknowledge that the Service is the intellectual property of the Administrator, protected by applicable law. Intellectual property rights to the Service name, domain, website, and other creative elements belong exclusively to the Administrator.
  12. You acknowledge and agree that the Administrator may review data, materials, and content you post and may remove or modify them without prior notice.
  13. You will not conduct any activities harmful to the image or otherwise damaging to the Owner, Service, Administrator, or other users.
  14. You will maintain coherent and clear communication, which means you will not use spam messages (duplicating identical or very similar messages; sending mass one- or two-word messages on separate lines).
  15. The Service may contain links to other services, as well as content, graphics, and materials belonging to or originating from other services, posted and shared by Users. The Administrator bears no responsibility for their content or operation. Users who decide to leave the Service and/or use, install software and applications from other services do so at their own risk, aware that these Terms of Service may not apply there.
  16. Using the Service requires an appropriate device capable of browsing web content, including a web browser in the most current version possible, supporting and accepting cookies, JavaScript, and HTML5 technology. Using a browser that does not meet these requirements may cause Service malfunctions, for which the Administrator is not responsible. By using the Service, you consent to storing cookies on your device.
  17. You waive any claims now and in the future regarding contractual and tortious liability against the Service, Administrator, and Service Owner for damages that may arise from your own actions or omissions, actions of other users, or third parties.

4. Age Requirement

  • You must be at least 18 years old to use this Service
  • By using the Service, you certify that you are 18 years of age or older
  • We reserve the right to verify age and terminate accounts of users who are or appear to be under 18

5. User Accounts

  • You may use the Service anonymously with limited features, or create an account for full access
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must provide accurate and complete information when creating an account
  • You may delete your account at any time through account settings

6. Administrator Rights and Obligations

The Administrator reserves the right to:

  1. Modify or change these Terms at any time without prior notice.
  2. Refuse registration or publication of data and materials submitted by users.
  3. Review data and materials posted by users.
  4. Delete and modify any data and content posted by users, as well as account elements, if they do not comply with the Terms or are subjectively inappropriate for publication on the Service.
  5. Block or permanently delete user accounts without prior warning, for any reason, particularly for violation of the Terms or applicable law.
  6. Temporarily or permanently suspend Service operations, implement technical breaks, or completely cease its operation.

7. AI-Generated Content

All responses from AI personas are generated by artificial intelligence and should be treated as entertainment. The AI may produce inaccurate, inappropriate, or unexpected content.

Important: AI personas are not substitutes for professional advice (medical, legal, financial, etc.). Wispers takes no responsibility for dialogues created by AI personas.

8. Limitation of Liability - The Administrator is NOT Responsible for:

  1. The authenticity, reliability, or truthfulness of data and content published on the Service, especially content published by users.
  2. Consequences resulting from users posting information, data, and materials on the Service, and any resulting claims from users or third parties.
  3. Consequences of using the Service, particularly relationships between users on the Service and beyond.
  4. Potential loss of user funds resulting from Service use in cases of circumstances beyond the Administrator's control, technical failures, user violation of the Terms, unwanted actions by third parties, or force majeure.
  5. Consequences of account hacking and unauthorized access to user accounts by third parties.
  6. Consequences of third parties, including users, using data and materials posted on the Service, including copying and sharing data and materials on other websites.
  7. Loss of collected data and materials due to external causes, hardware failures, account blocking or deletion, or actions by third parties.
  8. The substantive content of materials and content posted by users.
  9. Any user materials, content, applications, and materials from other services that may be published or made available by users.
  10. The accuracy, completeness, authenticity, reliability, or currentness of AI-generated responses.
  11. Decisions made based on AI conversations or emotional impact of AI interactions.

The Administrator cannot guarantee and does not promise any specific results from using the Service. The Administrator does not claim or guarantee that materials and content posted on the site are accurate, complete, authentic, reliable, current, or error-free, or that the Service, its servers, or applications are free from viruses or other harmful components.

9. Account Blocking and Deletion

  1. The Administrator may block a user's account, temporarily or permanently, without prior warning, for violation of Polish law, and after warning for any significant reason violating social norms, particularly any provision of these Terms. An account may be blocked or even deleted for: posting pornographic or obscene photos, posting photos of another person without permission, posting photos suggesting a person may be a minor regardless of content nature, disrespecting other users and using words considered vulgar toward someone who does not wish it and reports it to the Administrator, attempting to disclose to third parties the identity of a person with whom you correspond without that person's consent, etc.
  2. The Administrator may permanently delete an account of a user who, despite Administrator warning, continues to violate the Terms, applicable law, or social norms.
  3. Users may independently delete their accounts at any time through account settings.

10. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Harass, abuse, or harm another person
  • Post content involving minors in any way
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any unauthorized commercial purpose
  • Impersonate any person or entity
  • Collect or harvest user information without consent
  • Advertise competing services, particularly chat platforms or social media

11. User Content and Intellectual Property

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely for providing the Service.

The Service and its original content, features, and functionality are owned by Wispers and are protected by international copyright, trademark, and other intellectual property laws.

12. Privacy

Your use of the Service is subject to our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

13. Payments and Subscriptions

If we offer paid features or subscriptions:

  • Prices are subject to change with notice
  • Subscriptions auto-renew unless cancelled
  • Refunds are provided in accordance with our refund policy
  • You are responsible for all charges incurred under your account

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Material changes will be communicated to users. Your continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
